2. Agreeing to these terms
By using this website you agree to these terms. If you do not agree, please do not use the site. We may update these terms from time to time; the date at the top shows when they last changed.
3. Information on this site
The information on this site is provided for general guidance about business energy and our service. Prices, rates and savings mentioned on the site, including the example bill on the home page, are illustrative only. Any quote we give you will be confirmed in writing before you agree to anything, and it is that written quote, not the website, that applies.
We try to keep the site accurate and up to date but we cannot guarantee that it is free of errors or that it will always be available.
4. Enquiries made through this site
Sending an enquiry through a form on this site does not create a contract with us or with any energy supplier. It asks us to contact you. We will use the details you provide as described in our privacy and cookies policy.
5. Intellectual property
The content of this site, including text, design, the Blue Fish Energy name and logo, belongs to us or our licensors. You may view and print pages for your own business use. You may not copy, reproduce or reuse the content for any other purpose without our written permission. Photographs are used under licence from their photographers.
6. Links to other sites
Where we link to other websites, we are not responsible for their content or their handling of your information.
7. Liability for the website
To the extent permitted by law, we are not liable for any loss arising from your use of, or inability to use, this website or the information on it. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
B. Our brokerage service
8. What we do
Blue Fish Energy is an independent energy broker, sometimes called a third-party intermediary. We compare gas, electricity and water contracts available to your business, explain the options, and, if you ask us to, arrange a contract between you and the supplier you choose. We act as an intermediary. The supply contract itself is between you and the supplier, on the supplier's terms, which we will provide to you before you agree.
9. Who the service is for
Our service is for businesses and other non-domestic customers. We do not arrange domestic energy contracts.
10. How we are paid
Our service is free for you to use. When you enter into a contract we have arranged, the supplier pays us a commission. That commission is built into the unit rates you pay. Before you agree to any contract we will tell you, in writing, how much commission we will receive for it, expressed as a rate per kWh and as an estimated total for the contract term, and we will answer any questions you have about it.
11. Our commitments to you
- We will base our recommendations on what we believe is genuinely best for your business, not on which supplier pays us most.
- We will explain contract terms in plain English, including the length, the rates, standing charges, exit fees and what happens at the end of the contract.
- We will not pressure you to decide. You may take as long as you need and you may decline any quote.
- We will confirm everything in writing before a contract is placed. We do not treat a verbal conversation as your agreement to a contract.
- We will remind you before your contract ends and, if you wish, compare the market again for you.
12. What we need from you
To compare accurately we need correct information about your business, sites, meters, usage and current contract. If information you give us is wrong or incomplete, quotes based on it may not be honoured by the supplier. If you have a current contract, you are responsible for any termination notice it requires; we will help you check this.
13. Authority to act
Where you ask us to obtain information from your current supplier or to arrange a switch on your behalf, we will ask you to confirm that authority in writing (a letter of authority). You can withdraw it at any time by telling us.
14. Cooling off and cancellation
Business energy contracts do not normally carry a statutory cooling-off period. Once you have agreed a contract with a supplier and the supplier has accepted it, cancelling may not be possible or may incur charges under the supplier's terms. We will make sure you understand this before you agree.
15. Our liability for the service
We take care in the information and recommendations we give, but the final decision on any contract is yours. We are not responsible for a supplier's performance, pricing changes made by a supplier in line with its own terms, or for wholesale market movements. To the extent permitted by law, our total liability to you in connection with our service is limited to the commission we received in respect of the contract concerned.
16. Complaints and dispute resolution
If something goes wrong, please tell us. Email enquiries@bluefishenergy.co.uk or call 020 3984 3500. We will acknowledge your complaint within 5 working days and aim to resolve it within 8 weeks. Our full complaints and alternative dispute resolution procedure is available on request.
If you are a microbusiness (broadly, fewer than 10 employees and turnover or balance sheet under €2 million, or using less than 100,000 kWh of electricity or 293,000 kWh of gas a year) and we cannot resolve your complaint, you may be able to refer it to the Energy Ombudsman, which handles complaints about energy brokers for eligible customers. 17. Data protection

18. General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute relating to them. If any part of these terms is found to be unenforceable, the rest continues to apply.
